1. Agreement
These Terms of Service are an agreement between you and Dialect Agency Inc. DBA Super Simple (“Super Simple,” “we,” “us”). By downloading, installing, or using Continuity, or by using this website, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the app or the website.
You must be at least 13 and legally capable of entering this agreement. If you use the app for an organization, you represent that you have authority to bind that organization.
2. License
Continuity is licensed, not sold. Subject to these terms and Apple’s usage rules, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, for lawful purposes.
The app is distributed through the App Store and is also subject to Apple’s Standard Licensed Application End User License Agreement. Where that agreement is legally required or directly conflicts with these terms, it controls to that extent.
3. Your journal
Everything you write in Continuity is yours. We claim no rights in your pages, and because they never reach us, we grant ourselves none. You are responsible for what you write, for keeping copies you care about, and for the files you export and where you put them.
Continuity stores your journal on your devices and, if you turn it on, in your own iCloud account. Sync depends on Apple’s services, your Apple Account, and your devices’ settings, none of which we control. Keep an export if a copy outside Apple’s systems matters to you.
4. The vault and the recovery key
The vault seals your pages on the device with a PIN of your choosing and a recovery key that the app shows once. Neither is stored by us or recoverable by us. If you forget the PIN and do not have the recovery key, the sealed pages cannot be opened by anyone, and we cannot help. By turning the vault on, you accept that risk and agree to keep the recovery key somewhere safe that is not the same device.
5. Mood and the Atlas
Mood words and the people, places, and themes in the Atlas are inferred on your device from your own writing. They are a reading, not a diagnosis, and they will sometimes be wrong; the app gives you hide and merge for exactly that reason. Continuity is not a medical, mental-health, or emergency service, and nothing it shows you is advice.
6. Purchases
Continuity is free. If a purchase or subscription is ever offered, the price, trial terms, renewal period, taxes, and payment details shown by the App Store at the time of purchase will control it. Subscriptions, if any, would renew automatically unless canceled through your Apple Account before renewal, and deleting the app would not cancel one. Refunds and billing disputes are handled by Apple under App Store policy and applicable law.
7. Acceptable use
You may not:
- Use the app or website unlawfully or to violate another person’s rights.
- Interfere with the security, availability, or normal operation of the app, the website, or Apple’s services.
- Introduce malicious code, automate abusive traffic, or attempt to bypass access controls.
- Reverse engineer, decompile, or redistribute the app except where applicable law expressly permits it.
8. Apple and other third parties
Continuity relies on services and software we do not control, including the App Store, iCloud, CloudKit, and the operating system. Their terms and privacy practices apply to their services. Changes, outages, or restrictions imposed by Apple may affect the app or require us to change it. Apple is not a sponsor of Continuity, and third-party names and marks belong to their owners.
9. Ownership and feedback
Continuity, its software, design, website, branding, and documentation are owned by Dialect Agency Inc. or its licensors and are protected by intellectual-property law. No rights are granted except those expressly stated in these terms. The app embeds the iA Writer Quattro typeface under the SIL Open Font License. If you send us feedback, you permit us to use it without restriction or compensation, and we remain responsible for our own implementation.
10. Changes and availability
We may update, add, remove, suspend, or discontinue features or the app itself. We aim to preserve the journal on your devices and to communicate material changes when reasonable, but uninterrupted or error-free operation is not guaranteed. You are responsible for keeping backups of anything important to you.
11. Disclaimers
To the maximum extent permitted by law, the app and website are provided “as is” and “as available.” We disclaim warranties not expressly required by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these terms limits warranties or consumer rights that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, Dialect Agency Inc. and its directors, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, pages, profits, revenue, goodwill, or business opportunity arising from the app, the website, or these terms. Our aggregate liability will not exceed the greater of the amount you paid for the app in the 12 months before the event giving rise to the claim or the minimum amount required by applicable law.
13. Indemnity
To the extent permitted by law, you agree to defend and indemnify Dialect Agency Inc. from third-party claims, damages, and reasonable costs arising from your unlawful misuse of the app, violation of these terms, or violation of another person’s rights. This obligation does not apply where prohibited by consumer law.
14. Termination
You may stop using the app at any time by deleting it. We may suspend or terminate your license when reasonably necessary to address unlawful use, security threats, a material breach of these terms, or discontinuation of the app. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, indemnity, and governing law.
15. Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where the law of your residence or another mandatory consumer law applies. Subject to those mandatory rights, disputes may be brought in the state or federal courts with jurisdiction in Albany County, New York. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
16. Changes to these terms
We may update these terms to reflect product, business, or legal changes. We will post the updated terms here and revise the effective date, and we will provide additional notice or request consent when the law requires it.
